REFUND POLICY

This Refund Policy forms part of the SUPERFOLIO Terms and Conditions and applies to all purchases, subscriptions, renewals, upgrades, add-ons, paid features, paid plans, promotional offers, one-time charges, recurring charges, custom billing arrangements, and other payments made in connection with SUPERFOLIO.

For limited legal identification purposes only, SUPERFOLIO is operated by Scalith, LLC. Except where the context requires otherwise, “SUPERFOLIO,” “we,” “us,” and “our” refer to the SUPERFOLIO service, platform, website, products, and their operator, personnel, vendors, licensors, service providers, contractors, affiliates, successors, and assigns.

By purchasing, subscribing to, upgrading, renewing, using, accessing, or continuing to use any paid SUPERFOLIO feature, plan, product, or service, you acknowledge and agree to this Refund Policy.

1. No Refunds

All payments made to SUPERFOLIO are final, non-cancellable, and non-refundable, except only where a refund is expressly required by applicable non-waivable law.

Without limitation, SUPERFOLIO does not provide refunds, credits, reversals, chargebacks, partial refunds, prorated refunds, goodwill refunds, discretionary refunds, account credits, service credits, billing-period extensions, or compensation for:

  • unused time;
  • unused features;
  • unused seats;
  • unused Account access;
  • unused Portfolio access;
  • unused subscription periods;
  • failure to use the Service;
  • failure to publish a Portfolio;
  • failure to complete Account setup;
  • failure to complete verification;
  • failure to receive a Verification Badge;
  • removal, suspension, or denial of a Verification Badge;
  • dissatisfaction with the Service;
  • dissatisfaction with feature availability;
  • dissatisfaction with platform design;
  • dissatisfaction with templates;
  • dissatisfaction with analytics;
  • dissatisfaction with tracking results;
  • dissatisfaction with integrations;
  • dissatisfaction with third-party embeds;
  • dissatisfaction with public Portfolio performance;
  • lack of leads, clients, sales, bookings, revenue, conversions, impressions, profile views, or business outcomes;
  • mistaken purchases;
  • accidental purchases;
  • duplicate Account creation;
  • forgetting to cancel;
  • auto-renewal charges;
  • unused free-trial or paid-trial periods;
  • failure to downgrade before renewal;
  • failure to cancel before renewal;
  • Account inactivity;
  • business closure;
  • change of business plans;
  • change of mind;
  • technical issues caused by your device, browser, network, settings, integrations, third-party services, or misuse;
  • temporary interruptions, downtime, bugs, delays, maintenance, or feature changes;
  • suspension, restriction, downgrade, or termination caused by breach, suspected breach, abuse, nonpayment, legal risk, security risk, or policy violation;
  • or any other reason not expressly required by applicable non-waivable law.

2. Subscription Renewals Are Non-Refundable

SUPERFOLIO subscriptions may renew automatically unless cancelled before the next billing date.

You are solely responsible for monitoring your billing cycle, renewal date, subscription status, plan type, payment method, invoices, and cancellation settings.

Renewal charges are final and non-refundable. Failure to use the Service after renewal does not entitle you to any refund or credit.

If you do not want to be charged for a future renewal, you must cancel your subscription before the renewal charge is processed.

3. Cancellation Does Not Create a Refund Right

You may cancel your subscription where cancellation functionality is made available through your Account, billing portal, or support process.

Cancellation stops future renewals according to the applicable plan terms, but it does not refund past charges or current billing-period charges.

Unless SUPERFOLIO expressly states otherwise in writing, cancellation takes effect at the end of the then-current billing period. You may continue to have access to paid features until the end of the paid period, subject to the Terms and Conditions, plan limits, and any enforcement action.

No refund, credit, or prorated amount will be provided for the remaining portion of a billing period after cancellation.

4. Downgrades Do Not Create a Refund Right

If you downgrade from a paid plan to a lower-tier plan or free plan, the downgrade may take effect immediately or at the end of the current billing period, depending on SUPERFOLIO’s billing configuration, product settings, and plan rules.

Downgrading does not entitle you to a refund, credit, proration, cash adjustment, service extension, or compensation for the difference between plans.

You are solely responsible for reviewing the features, limitations, billing terms, and consequences of any downgrade before confirming it.

5. Upgrades, Add-Ons, and One-Time Charges Are Non-Refundable

All upgrades, add-ons, premium features, usage-based charges, setup fees, one-time payments, custom charges, extra seats, verification-related charges, API-related charges, integration-related charges, and other paid items are final and non-refundable.

If SUPERFOLIO charges a prorated amount for an upgrade or plan change, that prorated amount is also final and non-refundable.

6. Free Plans and Trials

SUPERFOLIO may offer free plans, free trials, paid trials, promotional trials, limited trials, beta access, early access, discounted access, or other promotional access at its sole discretion.

SUPERFOLIO may modify, limit, suspend, discontinue, or withdraw any free plan, trial, discount, or promotional offer at any time.

If a trial converts into a paid subscription, or if you choose to purchase a paid plan after a trial, all resulting charges are final and non-refundable.

Failure to cancel before the end of a trial or promotional period does not entitle you to a refund.

7. No Refunds for Lack of Business Results

SUPERFOLIO is a software platform for creating, organizing, hosting, displaying, and managing portfolio-style pages and related materials.

SUPERFOLIO does not guarantee that you will receive any specific outcome from using the Service.

Without limitation, SUPERFOLIO does not guarantee:

  • leads;
  • clients;
  • sales;
  • revenue;
  • bookings;
  • calls;
  • conversions;
  • profile views;
  • portfolio views;
  • engagement;
  • trust;
  • credibility;
  • search visibility;
  • social proof;
  • ranking;
  • business growth;
  • successful customer acquisition;
  • successful hiring;
  • successful sales outcomes;
  • successful service delivery;
  • successful verification;
  • or any other commercial, professional, reputational, financial, or business result.

No refund shall be owed because you did not receive the business, sales, marketing, professional, reputational, or operational outcome you expected.

8. No Refunds for User Content Issues

You are solely responsible for all Content you upload, publish, display, embed, link, transmit, or otherwise use through SUPERFOLIO.

SUPERFOLIO does not fact-check, verify, validate, investigate, audit, approve, warrant, guarantee, or certify your Content.

No refund shall be owed due to:

  • Content rejection;
  • Content removal;
  • Content moderation;
  • Content restriction;
  • copyright complaints;
  • trademark complaints;
  • privacy complaints;
  • publicity-right complaints;
  • testimonial complaints;
  • review complaints;
  • customer-logo complaints;
  • client-permission issues;
  • false or misleading Content;
  • unauthorized Content;
  • infringing Content;
  • unlawful Content;
  • defamatory Content;
  • deceptive Content;
  • Portfolio suspension;
  • Portfolio removal;
  • or any other issue relating to Content submitted by you or on your behalf.

9. No Refunds for Verification Issues

SUPERFOLIO may offer optional verification-badge features through external verification providers.

Payment for any plan, feature, or service does not guarantee successful identity verification, approval by a verification provider, display of a Verification Badge, continued display of a Verification Badge, or any specific verification outcome.

No refund shall be owed because:

  • you failed verification;
  • your verification was delayed;
  • your verification was rejected;
  • your verification could not be completed;
  • you abandoned the verification process;
  • you provided incomplete information;
  • you provided incorrect information;
  • you provided unverifiable information;
  • your documents were not accepted;
  • your face or liveness check failed;
  • a third-party verification provider declined approval;
  • SUPERFOLIO removed, suspended, withheld, denied, or modified a Verification Badge;
  • a Verification Badge did not produce trust, leads, sales, clients, or business outcomes;
  • or verification was unavailable, inaccurate, delayed, limited, or affected by technical or third-party issues.

Verification features are provided subject to the Terms and Conditions and Privacy Policy.

10. No Refunds for Third-Party Services, Embeds, or Integrations

SUPERFOLIO may allow Users to connect, embed, display, integrate, transmit data to, or receive data from Third-Party Services.

SUPERFOLIO is not responsible for Third-Party Services, including their availability, pricing, quality, performance, compatibility, legality, security, privacy practices, downtime, bugs, errors, policy changes, account restrictions, API limits, failed connections, or discontinued services.

No refund shall be owed because of any issue involving a Third-Party Service, including:

  • calendar embeds;
  • booking embeds;
  • video embeds;
  • form embeds;
  • payment tools;
  • analytics tools;
  • identity-verification providers;
  • webhook endpoints;
  • API recipients;
  • automation tools;
  • CRM systems;
  • browser restrictions;
  • third-party cookies;
  • third-party tracking limits;
  • third-party account suspension;
  • third-party platform changes;
  • or any integration failure outside SUPERFOLIO’s sole control.

11. No Refunds for Downtime, Bugs, or Feature Changes

SUPERFOLIO may experience downtime, bugs, delays, degraded performance, maintenance, interruptions, errors, compatibility issues, data-processing delays, analytics delays, tracking inaccuracies, email delays, webhook delays, API limitations, or feature changes.

To the maximum extent permitted by law, such issues do not entitle you to any refund, credit, compensation, service extension, or billing adjustment.

SUPERFOLIO may add, remove, modify, rename, limit, replace, suspend, discontinue, or change any feature, plan, limit, integration, API endpoint, webhook functionality, template, analytics feature, tracking feature, verification feature, or other part of the Service at any time, with or without notice.

No refund shall be owed because a feature was changed, limited, removed, renamed, discontinued, or made available under a different plan.

12. Chargebacks and Payment Disputes

If you initiate a chargeback, payment dispute, reversal, retrieval request, or similar payment challenge for a valid charge, SUPERFOLIO reserves the right to:

  • suspend your Account;
  • restrict your Account;
  • terminate your Account;
  • remove or disable your Portfolio;
  • disable paid features;
  • revoke discounts or promotional access;
  • decline future purchases;
  • require payment through a different method;
  • recover chargeback fees;
  • recover collection costs;
  • recover legal costs;
  • and take any other action permitted by law or the Terms and Conditions.

You agree to contact support@superfolio.app before initiating any chargeback or payment dispute, so SUPERFOLIO has a reasonable opportunity to review the issue.

Filing a chargeback does not cancel your subscription. You remain responsible for cancelling future renewals through the applicable cancellation process.

13. Billing Errors

If you believe you were charged in error, you must contact support@superfolio.app within seven calendar days after the charge.

Your message must include:

  • Account email;
  • invoice number, if available;
  • charge date;
  • charge amount;
  • payment method identifier, if available;
  • description of the alleged billing error;
  • and any supporting information.

SUPERFOLIO may review alleged billing errors in its sole discretion.

Nothing in this section creates a general refund right. SUPERFOLIO may correct actual duplicate charges, technical billing errors, or charges that SUPERFOLIO determines were made in error. Any such correction shall not constitute a waiver of this Refund Policy or create any future refund obligation.

14. Taxes, Fees, Currency, and Exchange Rates

All prices may be exclusive of taxes, duties, levies, bank fees, card fees, foreign-exchange charges, payment-processor fees, or other charges unless expressly stated otherwise.

You are responsible for all taxes and third-party charges associated with your purchase.

SUPERFOLIO is not responsible for exchange-rate fluctuations, foreign-transaction fees, bank charges, card-network fees, payment-processor fees, tax gross-ups, withholding, or other charges imposed by third parties.

No refund shall be owed because of currency conversion, exchange-rate movement, bank fees, card fees, or tax treatment.

15. Abuse, Breach, Fraud, and Policy Violations

No refund shall be owed if your Account, Portfolio, access, subscription, Verification Badge, Content, or feature access is suspended, restricted, downgraded, disabled, removed, or terminated due to:

  • breach or suspected breach of the Terms and Conditions;
  • breach or suspected breach of this Refund Policy;
  • fraud or suspected fraud;
  • abuse or suspected abuse;
  • unlawful activity;
  • misleading Content;
  • unauthorized Content;
  • infringing Content;
  • security risk;
  • chargeback abuse;
  • payment failure;
  • nonpayment;
  • spam;
  • harassment;
  • platform misuse;
  • excessive burden on SUPERFOLIO systems;
  • violation of third-party rights;
  • violation of applicable law;
  • or any other conduct SUPERFOLIO determines, in its sole discretion, creates legal, operational, commercial, security, reputational, or platform-integrity risk.

16. Promotional Offers and Discounts

Promotional offers, discounts, coupons, credits, trials, founder offers, limited-time offers, beta offers, lifetime offers, migration offers, and special pricing are discretionary.

SUPERFOLIO may modify, revoke, discontinue, or refuse any promotional offer at any time where permitted by law.

Promotional pricing does not create a refund right. Expiration of a discount, failure to apply a coupon, failure to use a coupon, or later availability of a lower price does not entitle you to a refund, credit, price adjustment, or retroactive discount.

17. Account Deletion

Deleting your Account, deleting a Portfolio, unpublishing Content, removing payment information, disconnecting an integration, abandoning the Service, or ceasing to use SUPERFOLIO does not entitle you to a refund.

Account deletion does not automatically cancel all billing obligations unless the applicable subscription is cancelled according to the required cancellation process.

You are responsible for confirming that your subscription has been cancelled.

18. Non-Waivable Legal Rights

Nothing in this Refund Policy excludes, restricts, or limits any refund right that cannot legally be excluded, restricted, or limited under applicable law.

Where applicable non-waivable law requires a refund, SUPERFOLIO will provide only the minimum refund required by such law and no more.

To the maximum extent permitted by law, all other payments remain final and non-refundable.

19. Relationship to Terms and Conditions

This Refund Policy is incorporated into and forms part of the SUPERFOLIO Terms and Conditions.

To the maximum extent permitted by law, all disclaimers, limitations of liability, indemnification obligations, arbitration provisions, class-action waivers, jury-trial waivers, governing-law provisions, and other protections in the Terms and Conditions apply to this Refund Policy.

If there is a conflict between this Refund Policy and the Terms and Conditions regarding refunds, this Refund Policy controls solely with respect to refunds. All other provisions of the Terms and Conditions remain fully effective.
